1. INTRODUCTION

This Privacy Policy, together with the Terms of Use, sets out how TOTAL HEALTH SOLUTIONS(THS) and its companies (" DOCSYMEDSY HEALTHTECH PRIVATE LIMITED ", " we ", " us " or " our ") process personal data that we collect from you or that you provide to us when Access and use the Total Health Solutions, its mobile phone and mobile device applications, or related websites (“Services”). Our policy is to process your personal data in accordance with applicable data protection laws and regulations at all times.

“Personal Information” means any information that enables us to identify, directly or indirectly, an individual. “Affiliates” means any member of our group, including our subsidiaries, our holding company and its affiliates.

3. CHILDREN AND PRIVACY

Our website and mobile application do not offer products or services for use by minors. If you are under 18, you may use our website or mobile application only with the involvement of a parent or guardian.


4. COLLECTION AND USE OF PERSONAL DATA

We will process your personal data for the provision of the Services to you and/or for the lawful purpose of direct marketing. In particular, we collect the following types of personal data in relation to you for the following purposes:

(a) Information You Provide Directly to Us. When you register as a user for the Services and/or use the Services, you provide us with certain information that we store. This may include: username and password information you have provided to the Services; Your name, contact, Medical and other profile information that you may provide, e.g., B. Your address, phone number, email address and age; payment information you have provided to use the Services; User Content (e.g., photos, comments, and other material) that you upload or otherwise post to the Services; metadata associated with such User Content (as defined in Section 9 of the Total Health Solutions Terms of Service), which may include content creation date and formatting dates; location information about it, where User Content was collected (geotagged) and communications between us and you. We process such information to provide you with the Services, including account management, and to calculate compensation for content owners.

(b) Usage Data. When you use the Services, we collect and process information generated through your use of the Services, e.g. B. Medicine, Doctors records , doctors prescription, activity in the TOTAL HEALTH SOLUTIONS applications, medicine in cart, login time, which version of the TOTAL HEALTH SOLUTIONS client you are using. If you access the Services using a handheld device, we also store a number that uniquely identifies the device. We use this information (i) to tailor and/or personalize the Services to you, (ii) to improve the Services, and (iii) for marketing and promotional purposes (as further described in Section 10 below). We may also use internal or third-party analytics tools for our own analytics purposes, to help us measure visitor and usage trends for the Services. These tools collect information sent from your device or the Services to help us improve the Services. We collect and combine this information with analytical data from other visitors and users so that it cannot be used to identify a specific individual.

(c) Log File Information. This information may be automatically reported by your browser or device whenever you make a request to visit, access, or use the Services. When you access, access or use the Services, our servers may automatically collect certain log file information, including login time, which version of TOTAL HEALTH SOLUTIONS client you may be using, internet protocol ("IP") address, browser type, referring/exit -Pages and URLs, number of clicks and how you interact with links on the Services, domain names, landing pages, pages viewed, and other such information. We may also log device ID or other unique information for devices used to access the Services. In addition, we reserve the right Collect similar information from emails we send to you, which helps us track which emails are opened and which links are clicked by recipients. This information is used to (i) analyse usage of the Services, (ii) enable more accurate reports, (iii) improve the Services, and (iv) calculate compensation for content owners.

(d) Survey Data . When you respond to surveys we provide, the information you provide will be made anonymous and aggregated with responses from other users, unless otherwise noted, and used to improve the Services.

In addition to the specific uses of information we describe in this Privacy Policy, we may also use your Personal Information to: (i) process payments for use of the Services; (ii) help you access your information and features of the Services efficiently; (iii) store information so that you do not have to re-enter it during your visit or next time you use the Services; (iv) provide, improve and monitor the effectiveness of our Services; (v) develop and test new products and features; (vi) collect metrics such as total number of visitors, traffic and demographic patterns; (vii) diagnose or fix technical problems; and (viii) detect any misuse of the Services,

(e) Information Collected by Third Parties. We may receive information about you from third parties who may have collected and transmitted your personal information to us in accordance with their own privacy policies and/or terms of use. Examples of such third parties are social media networks such as Facebook, business partners, advertising networks, analytics service providers or other telecommunications providers through which you can access the Services (e.g. through a bundled package). Where we receive such information from third parties, we may combine it with the other personal information we have collected about you in the ways described above and use such information alone or in conjunction with the other personal information we have about the purposes set out in this Retain the purposes described in the Privacy Policy.

If we intend to use your personal data for purposes other than those set out above, we will inform you of the purpose of that processing and provide you with any other relevant information, either by updating this Privacy Policy or (in the case of material changes) by we will notify you via email/push notification.


5. DISCLOSURE OF INFORMATION TO THIRD PARTIES

We may share your information with our affiliates, on whom we rely to provide the Services, for the purposes set out in this Privacy Policy (see Section 4(a)-(e) for further details).

We may also share your personal information with third parties who are not our affiliated companies in the following situations:

(a) where you have given us your consent to share such personal information. This can be the case, for example, in connection with Facebook or other third parties. Unless you have expressly consented to it, we do not share such personal information with third parties (e.g., advertisers) for marketing purposes, and we will provide such third parties with aggregated, de-identified information collected about you and other users of the Services be able.

(b) When necessary for billing purposes. We share information with the billing provider to facilitate billing. Your billing and payment information is stored by the billing provider, not TOTAL HEALTH SOLUTIONS, and the billing provider processes such information in accordance with its own privacy policy from time to time.

(c) When we use third parties to perform services related to the Services on our behalf. In such cases, we remain responsible for your personal information and will ensure that any handling of such information is in accordance with this Privacy Policy and applicable laws.

(d) If we are required to do so: (i) by applicable law or in order to comply with a legal obligation. (ii) to enforce or apply this Privacy Policy or our Terms of Service. (iii) to protect the rights, property, or safety of TOTAL HEALTH SOLUTIONS, our customers, and others. This includes sharing information with other fraud protection and credit risk reduction organizations. You expressly consent to our collection and sharing of such fraud protection and credit risk reduction information.

(e) If we sell or acquire any business or assets, in which event we may transfer your personal information to the prospective seller or buyer of such business or assets.

(f) If we, or much of our assets, are acquired by a third party, in which case personal information held by us about our users will be one of the assets transferred.

(g) With third party rights holders whose content is licensed to us. The data that TOTAL HEALTH Solutions shares with rights holders is in an anonymized format that does not directly identify you unless you consent to the sharing of your personal data.

(h) If you dispute or dispute any of our charges, we may share your personal information with your credit card company or financial institution to help you resolve such disputes.

(I) Where you have expressly consented to this, we may collect certain information such as B. Share cookie data and streaming data (such as the number of plays of a particular song or playlist by all users) with third-party advertising partners to (a) enable third-party advertising networks, among other things, to serve targeted advertisements from the they believe will be of most interest to you; and (b) to deliver targeted emails and other communications to you regarding such advertisers, their products or services, and/or TOTAL HEALTH Solutions events that such advertisers sponsor or host.

We may remove parts of the data that identify you and share anonymised data with other parties. We may also combine your information with other information in such a way that it no longer identifies you and provide this aggregated, anonymized information to third parties. This data may include demographic data, e.g. B. how many users make up a certain age group, general places where user groups live, e.g. B. to determine who might be interested in attending a TOTAL HEALTH Solutions event and similar anonymized data.

Some of our affiliated companies and/or third parties may be located outside of the European Economic Area in countries whose laws may not provide adequate protection for your personal information. Before your personal information is shared with such affiliates or third parties (if applicable), we will take contractual or other reasonable steps necessary to ensure that your personal information is processed by such affiliates or third parties securely and in accordance with this Privacy Policy be treated.

Except as otherwise described in this Privacy Policy, we never sell your personal information to third parties or allow third parties to access your personal information for their own purposes.


6. PROTECTION OF PERSONAL DATA

We use appropriate technical and organizational measures to protect your personal data against unauthorized or unlawful processing and against accidental loss, destruction or damage. Your personal data is stored securely on protected devices. Only a limited number of employees have access to this device and only those with legitimate reasons have access to your personal information. Unfortunately, the transmission of your personal information over the internet is not completely secure. While we strive to protect your personal information, we cannot guarantee the security of such information when it is transmitted to us via the Internet: you accept that any such transmission of your personal information is at your own risk.


7. RETENTION

We will only keep your personal data for the period necessary to fulfil the purposes for which the data was collected or as long as required by law. When it is no longer necessary for us to retain such data, it will be deleted or anonymised in a secure and permanent manner, or access to it will be blocked to the extent that statutory retention requirements apply.


8. YOUR RIGHTS

You have a number of rights in relation to how we process your personal data. This includes the right:

  • to be informed about personal data that we hold about you;

  • request access to your personal data;

  • request that inaccurate personal data be amended or deleted;

  • request to restrict the processing of personal data for specific reasons;

  • receive a copy of your personal data in a machine-readable format and have it sent to another company;

  • to object to the processing of your personal data for specific reasons; and

  • lodge a complaint with the relevant supervisory authority if you believe that we have breached data protection laws.

9. COMMUNICATION

If you have provided us with your email address or telephone number, we will use this information to communicate with you on matters relating to the Services in accordance with your preferences, this Privacy Policy and applicable laws. Such information includes receipts for payments, information about changes in the Services, changes to the End User Agreement and this Privacy Policy. You may not be able to opt out of certain important email communications (eg, account verification, payment receipts, technical and security notices).


10. MARKETING AND ADVERTISING

We may share with you details of our products, services and events that may be of interest to you, including details of future streaming content, artist information and/or copies of our newsletter. We may also provide promotional offers and communications on behalf of third parties in relation to their products or services and/or events sponsored or hosted by such advertisers, where you have opted-in to receive such information from us. We do not sell or give your email address to other companies for their own marketing purposes. You can choose to opt out of some or all of these types of communications in your account settings.


11. COOKIES AND SIMILAR TECHNOLOGIES

A cookie is a small file placed on your device that allows TOTAL HEALTH Solutions and our partners to recognize your device when you return to the website. We use cookies to provide login functionality, store user preferences and understand how our websites are used.

We use both temporary ("session") and persistent cookies. We use the following cookies:

Strictly Necessary Cookies. These are cookies that are necessary for the operation of our website, including, for example, cookies that enable you to log in to secure areas of our website.

Analytical/Performance Cookies. These enable us to recognize and count the number of users and to see how users move around our website when they are using it. This helps us to improve the way our website works, for example by ensuring that users are finding what they are looking for easily.

Functionality Cookies. These are used to recognize you when you return to our website. This allows us to personalize our content for you, greet you by name and remember your preferences (e.g. your choice of language or region).

Targeting Cookies. These cookies record your visit to our website, the pages you have visited and the links you have opened. We use this information to better tailor our website and the advertising displayed on it to your interests. If you expressly consent to this, we may also share this information with third parties for this purpose, as explained in Section 5(i) above.

In addition to our own, cookies are also placed by Google Analytics, as described below.


12. INTEGRATION WITH THIRD PARTY SERVICES

Google Analytics: We use Google Analytics from Google on our websites to create anonymous usage statistics. If you have concerns about using Google Analytics, you should be aware that it is possible to block Google Analytics by installing a plug-in in your browser.  Please familiarize yourself with Google's privacy policy to understand how Google processes your personal data.


13. INTEGRATION WITH THIRD PARTY SITES

We may link to third party websites. TOTAL HEALTH Solutions does not control and shall not be liable for the privacy policies and content of third parties. Please review the privacy policy of the third-party site to understand how that third party will process your personal information.

We are not responsible for the practices employed by websites or services connected to or from the Services - such as Facebook and Twitter - including the information or content contained therein. If you use a link to move from our Services to another website or service, our Privacy Policy does not apply to those third-party websites or services. You’re browsing and interaction on any third party website or service, including those that have a link to our Services, are governed by that third party's own rules and policies. In addition, you understand and agree that we are not responsible and have no control over any third party that you authorize.


14. DETECTING ABUSE OF THE SERVICES

If we suspect misuse of the Services, we may combine the personal information we have collected in accordance with this Privacy Policy with other information to investigate the extent of the misuse and who is responsible.


15. ACCESS, RECTIFICATION AND DELETION

The Services are subject to constant improvement, and future changes may affect what personal data we store and how we process it. This Privacy Policy may be updated to reflect such changes, changes in the legal environment or improvements in how we handle personal information. Please check regularly for updates to the Privacy Policy. If we make material changes to the Privacy Policy, we will provide you with a notice, where appropriate, e.g. B. by sending you an email.
